  1. General

1.1         We reserve the right to amend these terms and conditions at any time, without any notice. It is your responsibility to read the terms and conditions each time you use this website and your continued use of the website depicts that you accept the latest terms and conditions.

 

  1. Ordering

2.1         After proceeding through the confirm order page, we will send you an order acknowledgment email. Please note this does not mean we have accepted your order, this simply means we have received your order.

2.2         Acceptance of your order will take place once we have despatched your items and we will send an email to you confirming despatch.

2.3         If we cannot accept your order, we will notify you by email or phone with a reason (look at 2.4 for example reasons) as to why we cannot accept your order.

2.4         We can decline your order for any reason which we feel is acceptable, for example: stock may be unavailable, pricing error, description error etc.

 

  1. Description and pricing of goods

3.1         The description and the price of goods will be displayed on the thewhiskingangel website at the time you place an order.

3.2         If after accepting your order we discover within 7 days that we cannot fulfill your order, we have the right to terminate the contract and give you a full refund or credit your account. In these circumstances, we will inform you as soon as possible.

3.3         If within 7 days of accepting your order we discover that some but not all of the items are unavailable, we will contact you as soon as possible, and you have the option to cancel your whole order or amend your order. If within 14 days we have not heard back from you, we will deliver the available goods and refund you for the unavailable goods.

3.4         We make every effort to ensure descriptions and pricing shown on the website are accurate. However, human error does sometimes occur, in this case we will contact you as soon as possible with an amended order and an explanation of the circumstance. Thereafter, you will have the option of:

3.4.1     Placing a new order with the correct pricing and description; or

3.4.2     Cancelling the entire order; or

3.4.3     Cancelling the part of the order that has errors.

3.5         If within 14 days we have not heard back from you with one of your options: 3.4.1, 3.4.2, 3.4.3, we will either cancel the entire order or we will fulfill the part of the order that did not have any errors in it.

3.6         In addition to the price, you may be required to pay a delivery charge which would be displayed during checkout, alternatively please refer to the delivery section.

3.7         Please note that promotional products may not be eligible to any further discounts. In this case discount coupons/vouchers cannot be used.

 

  1. Delivery

4.1         To ensure a safe, secure transaction, we can only deliver to your billing address.

4.2         We try to despatch most orders within 1 working day, however, on some occasions we are unable to do so because of various reasons and therefore we cannot be held responsible for any inconveniences caused.

4.3         If we cannot deliver to your address for any reason, we will contact you as soon as possible.

4.4         If you deliberately do not accept the goods, you will be responsible for any costs incurred as a result of this.

4.5         If the package or contents appears to be damaged or not in good condition, then please do not accept delivery. However, if you are unable to check the contents of the package then please sign the parcel as “unchecked”. If you do not do so, this may affect any claims thereafter.

4.6         We are not responsible for any additional tax, duty or other charges incurred at the destination on receipt of the goods.

4.7         If you place an order that is to be shipped outside the United Kingdom, it may take longer than expected for receipt of goods; this may be as a result of the package being inspected by customs.

4.8         We may not be able to ship some products outside the United Kingdom because of various country regulations, and therefore we will contact you regarding this, but we will be forced to cancel your order. However, we cannot be held responsible for any inconveniences caused to you as a result of this.

4.9         If for any reason items are returned back to us, we will contact you and try and resolve the issue accordingly, however, we cannot be held responsible for this issue.

4.10       Please refer to the delivery section for more information on delivery prices and estimated lead times.

4.11       If you were not present when a parcel has been delivered. It is your responsibility to follow the courier company’s procedures to obtain the parcel in the timescale required, depending on the courier company. Failure in doing so will result in the parcel being returned to thewhiskingangel, any chargers incurred in this process will thereafter be charged to you. You will be notified via email and the charge will be taken from your original payment method. We take no responsibility for parcels returned to us.

4.12       If you issue us an incorrect delivery address, we are not responsible for the consequences, and any further costs incurred in trying to correct the mistake will be charged to you.

 

  1. Payment

5.1         Payment will have to be made immediately after you checkout with thewhiskingangel. This does not mean your order has been accepted.

5.2         Payment can be made via various methods; you will see these options during the checkout process, alternatively refer to the payment section for further details.

5.3         All prices are inclusive of VAT

5.4         We cannot deliver to you until funds have cleared. Unless you have a business account where we have agreed credit facilities).

5.5         Bespoke orders will require a 50% deposit at the time of order. There after, the remainder of the payment must be completed 7 days prior to cake delivery or collection.

 

  1. Risk and Ownership

6.1         After delivery, goods are at your risk.

6.2         The ownership of goods will be passed to you, only once funds have been received by thewhiskingangel.

      7. Data protection

7.1         We will comply with the data protection act 1998 to keep your details secure, but we cannot be liable for unauthorised access to the information supplied by you.

       8. Images

8.1         Product images shown on the website may differ from the actual product and we cannot be held responsible for this.

     

       9. Copyright

9.1       You are not allowed to copy, modify, publish, sell, broadcast, distribute, alter or transfer any content/material on this website, whether in whole or in part. However, you may download, print or copy content/material for your personal non-commercial use.

 

       10. Cancellation rights

10.1       We do no accept any cancellations on freshly baked goods unless they are not made yet. Kindly email us and we will let you know if it is possible to do so.

10.2       To exercise your right of cancellation, you must give us written notice by email, giving details of your order. Thereafter we will contact you with an approval or disapproval of the return. Please do not just send the goods back, if you do, your cancellation rights will be void.

 

 

      11. Returns

11.1       Please note that we do not accept any returns unless there is something wrong with the goods.

 

       12. Miscellaneous

12.1       These terms of sale and the supply of goods will be subject to English law. The contract between us will be governed by the laws of England and any disputes between us will be resolved in the court of England.
